EUROPE - Summary of Directive 2024/825 of 28 February 2024

Adopted on February 28, 2024, and published on March 6, Directive (EU) 2024/825 strengthens consumer protection while encouraging businesses to adopt more sustainable practices. It amends two major European texts—Directives 2005/29/EC and 2011/83/EU—to regulate environmental claims and improve product sustainability information. The aim is to combat misleading practices and enable consumers to contribute more effectively to the green transition.

 

Regulating Greenwashing:

The directive now imposes strict requirements for all environmental communications. Claims such as "sustainable product," "environmentally friendly," or "carbon neutral" must be based on verifiable, objective, and accessible data. Ecolabels may only be used if they are based on a transparent and independent certification system. Vague or unsubstantiated claims will be prohibited, and any use of unrecognized labels may be considered a misleading business practice.

 

Expansion of Unfair Commercial Practices:

The text broadens the definition of misleading practices to include aspects related to product circularity, particularly durability, repairability, and recyclability. It will be prohibited to suggest that an item is more durable or repairable than it actually is, or to claim that a product is "carbon neutral" when it is only so through offsetting mechanisms. Communications that conceal information about product deterioration or encourage the premature replacement of parts or consumables are also targeted.

 

Strengthening consumer information:

Companies will now be required to communicate clearly and visibly on the lifespan of goods, the availability and cost of spare parts, as well as on maintenance and repair procedures. A repairability index will be introduced to assess how easily a product can be repaired. These obligations directly concern the textile sector, where the concepts of durability, repairability, and traceability are playing an increasingly important role in communication and customer loyalty.

The directive also provides for the creation of a harmonized instruction leaflet and label at the European Union level. These will reiterate the main elements of the legal guarantee of conformity, which has a minimum duration of two years, and will aim to ensure consistent and understandable information for all European consumers.

 

Implementation schedule

Member States must transpose the directive by March 27, 2026, for effective application from September 27, 2026. Companies therefore have two years to adapt their marketing materials, labels, and environmental claims, ensuring that all claims are based on concrete, verifiable evidence and comply with the new European requirements.
